Inamed Implant

Inamed liability?
Inamed manufactures a medical divise that is implanted to help people lose wt., called a Lap Band. I had one placed in 2006, it began leaking and had to have it removed emergentlly. Does Inamed have a responsibility to replace the devise and compenstate my insurance company for the second surgery?
